Informativa sul trattamento dei dati personali

ai sensi dell'art. 13 del Regolamento (UE) 2016/679 ("GDPR")

La presente informativa descrive come vengono trattati i dati personali degli utenti che visitano il sito https://hawkings.it (il "Sito") e di chi prenota una demo attraverso di esso.

1. Titolare del trattamento

Hawkings S.r.l., con sede legale in Via Cavalieri di Vittorio Veneto, 4, 24060 Carobbio degli Angeli (BG), P.IVA e C.F. 04892260169, iscritta al Registro delle Imprese di Bergamo, REA BG-497085. Contatti per la privacy: info@hawkings.it - PEC: hawkings@pec.it.

Il Titolare non ha nominato un Responsabile della protezione dei dati (DPO), non essendo obbligato ai sensi dell'art. 37 GDPR.

2. Dati trattati

a) Dati di navigazione. I sistemi informatici che fanno funzionare il Sito acquisiscono, nel normale esercizio, alcuni dati tecnici la cui trasmissione è implicita nell'uso dei protocolli Internet: indirizzo IP, data e ora della richiesta, pagina richiesta, tipo di browser e sistema operativo. Questi dati sono registrati nei log del server e non sono usati per identificare l'utente.

b) Dati forniti per la prenotazione della demo. Se l'utente prenota una demo tramite il calendario presente sul Sito, vengono raccolti i dati inseriti nel modulo di prenotazione: nome e cognome, indirizzo email, eventuale azienda, eventuali note e data e ora dell'appuntamento scelto.

c) Dati forniti spontaneamente. Se l'utente scrive agli indirizzi indicati sul Sito, vengono trattati l'indirizzo del mittente e gli altri dati contenuti nel messaggio.

Il Sito non utilizza cookie di profilazione né strumenti di analisi statistica o pubblicitari. Per i dettagli si rinvia alla Cookie Policy.

3. Finalità, basi giuridiche e tempi di conservazione

Quando la base giuridica è il legittimo interesse, il Titolare ha effettuato un bilanciamento ai sensi dell'art. 6, par. 1, lett. f) GDPR, verificando che i propri interessi non prevalgano sui diritti e le libertà fondamentali dell'interessato. L'interessato può richiedere informazioni su tale bilanciamento scrivendo ai contatti indicati al par. 1.

I dati non sono utilizzati per finalità di marketing né ceduti a terzi per loro finalità autonome. Qualora il Titolare intendesse inviare comunicazioni commerciali, lo farà solo nei limiti consentiti dalla legge e, ove necessario, previo consenso dell'interessato.

4. Natura del conferimento

Il conferimento dei dati di navigazione è necessario per l'uso del Sito. Il conferimento dei dati per la prenotazione è facoltativo, ma senza di essi non è possibile fissare la demo.

5. Destinatari dei dati

I dati sono trattati da personale autorizzato del Titolare e possono essere comunicati ai seguenti soggetti, che agiscono come responsabili del trattamento ai sensi dell'art. 28 GDPR:

• IONOS SE, Elgendorfer Str. 57, 56410 Montabaur (Germania), fornitore del servizio di hosting del Sito, con server nell'Unione Europea;
• Cuadro S.r.l., Via Toscana 45/1, 43123 Parma, P.IVA 03104310341, società del gruppo che gestisce per conto del Titolare il calendario delle prenotazioni;
• Cal.com, Inc., 2261 Market Street #4382, San Francisco, CA 94114 (USA), fornitore della piattaforma di prenotazione, nominato sub-responsabile.

I dati possono inoltre essere comunicati a consulenti e professionisti del Titolare (es. legali, commercialisti) e ad autorità pubbliche, nei casi previsti dalla legge.

6. Trasferimento dei dati fuori dall'Unione Europea

I dati inseriti nel calendario di prenotazione sono trattati da Cal.com, Inc. negli Stati Uniti. Il trasferimento avviene sulla base delle Clausole Contrattuali Standard adottate dalla Commissione Europea con Decisione di esecuzione (UE) 2021/914, ai sensi dell'art. 46, par. 2, lett. c) GDPR, incluse nell'accordo sul trattamento dei dati di Cal.com. Maggiori informazioni sono disponibili nella privacy policy di Cal.com (https://cal.com/privacy).

L'interessato può ottenere copia delle garanzie adottate scrivendo a info@hawkings.it.

Gli altri dati (navigazione e hosting) sono trattati all'interno dell'Unione Europea.

7. Diritti dell'interessato

L'interessato può esercitare in qualsiasi momento i seguenti diritti previsti dal GDPR:

• accesso ai propri dati personali e alle informazioni sul trattamento (art. 15);
• rettifica dei dati inesatti o integrazione di quelli incompleti (art. 16);
• cancellazione ("diritto all'oblio"), nei casi previsti dalla legge (art. 17);
• limitazione del trattamento, nei casi previsti dalla legge (art. 18);
• portabilità dei dati, cioè ricevere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i dati forniti al Titolare (art. 20);
• opposizione al trattamento basato sul legittimo interesse, per motivi connessi alla propria situazione particolare (art. 21);
• revoca del consenso in qualsiasi momento, senza pregiudicare la liceità del trattamento basato sul consenso prestato prima della revoca (art. 7, par. 3), ove applicabile.

Le richieste vanno inviate a info@hawkings.it o tramite PEC a hawkings@pec.it. Il Titolare risponde senza ingiustificato ritardo e comunque entro un mese dal ricevimento; il termine può essere prorogato di due mesi, se necessario, tenuto conto della complessità e del numero delle richieste (art. 12, par. 3 GDPR). L'esercizio dei diritti è gratuito, salvo richieste manifestamente infondate o eccessive.

L'interessato ha inoltre il diritto di proporre reclamo al Garante per la protezione dei dati personali, Piazza Venezia 11, 00187 Roma (www.garanteprivacy.it - protocollo@pec.gpdp.it), o all'autorità di controllo dello Stato membro UE in cui risiede abitualmente, lavora o in cui si è verificata la presunta violazione.

8. Processi decisionali automatizzati

Il Titolare non adotta decisioni basate unicamente su trattamenti automatizzati, compresa la profilazione, che producano effetti giuridici sull'interessato o che incidano in modo analogo significativamente sulla sua persona (art. 22 GDPR). Le interazioni con il Sito, incluse le simulazioni del prodotto, non comportano alcun trattamento decisionale automatizzato.

9. Minori

Il Sito è rivolto a imprese e professionisti. Il Titolare non raccoglie consapevolmente dati di minori di 18 anni.

10. Modifiche all'informativa

Il Titolare può aggiornare la presente informativa, anche in seguito a modifiche normative o all'introduzione di nuovi servizi. La versione in vigore è sempre pubblicata su questa pagina, con la data dell'ultimo aggiornamento.

This policy describes how the personal data of users who visit the website https://hawkings.it (the "Website") and of those who book a demo through it are processed.

1. Data Controller

Hawkings S.r.l., with registered office at Via Cavalieri di Vittorio Veneto, 4, 24060 Carobbio degli Angeli (BG), Italy, VAT and tax code 04892260169, registered with the Companies Register of Bergamo, REA BG-497085. Privacy contact: info@hawkings.it - Certified email (PEC): hawkings@pec.it.

The Controller has not appointed a Data Protection Officer (DPO), as it is not required to do so under Art. 37 GDPR.

2. Data processed

a) Browsing data. The IT systems operating the Website automatically collect, during normal operation, certain technical data whose transmission is implicit in the use of Internet protocols: IP address, date and time of the request, page requested, browser type and operating system. These data are recorded in the server logs and are not used to identify the user.

b) Data provided for booking a demo. If the user books a demo through the calendar on the Website, the data entered in the booking form are collected: first and last name, email address, company name (if provided), any notes, and the date and time of the chosen appointment.

c) Data provided voluntarily. If the user writes to the addresses indicated on the Website, the sender's address and any other data contained in the message are processed.

The Website does not use profiling cookies, statistical analysis tools or advertising tools. For details, please refer to the Cookie Policy.

3. Purposes, legal bases and retention periods

Where the legal basis is legitimate interest, the Controller has carried out a balancing test pursuant to Art. 6(1)(f) GDPR, verifying that its interests do not override the fundamental rights and freedoms of the data subject. The data subject may request information on this balancing test by writing to the contacts indicated in Section 1.

Data are not used for marketing purposes nor disclosed to third parties for their own independent purposes. Should the Controller wish to send commercial communications, it will do so only within the limits permitted by law and, where required, with the prior consent of the data subject.

4. Nature of data provision

The provision of browsing data is necessary for the use of the Website. The provision of data for booking is optional, but without such data it is not possible to schedule the demo.

5. Recipients of data

Data are processed by authorised personnel of the Controller and may be disclosed to the following entities, acting as data processors pursuant to Art. 28 GDPR:

• IONOS SE, Elgendorfer Str. 57, 56410 Montabaur (Germany), Website hosting provider, with servers in the European Union;
• Cuadro S.r.l., Via Toscana 45/1, 43123 Parma, Italy, VAT no. 03104310341, a group company that manages the booking calendar on behalf of the Controller;
• Cal.com, Inc., 2261 Market Street #4382, San Francisco, CA 94114 (USA), provider of the booking platform, appointed as sub-processor.

Data may also be disclosed to consultants and professionals engaged by the Controller (e.g. lawyers, accountants) and to public authorities, in the cases provided for by law.

6. Transfer of data outside the European Union

Data entered in the booking calendar are processed by Cal.com, Inc. in the United States. The transfer is based on the Standard Contractual Clauses adopted by the European Commission with Implementing Decision (EU) 2021/914, pursuant to Art. 46(2)(c) GDPR, incorporated in Cal.com's data processing agreement. Further information is available in Cal.com's privacy policy (https://cal.com/privacy).

The data subject may obtain a copy of the safeguards adopted by writing to info@hawkings.it.

All other data (browsing and hosting) are processed within the European Union.

7. Rights of the data subject

The data subject may exercise the following rights under the GDPR at any time:

• access to their personal data and information about the processing (Art. 15);
• rectification of inaccurate data or completion of incomplete data (Art. 16);
• erasure ("right to be forgotten"), in the cases provided for by law (Art. 17);
• restriction of processing, in the cases provided for by law (Art. 18);
• data portability, i.e. receiving in a structured, commonly used and machine-readable format the data provided to the Controller (Art. 20);
• objection to processing based on legitimate interest, on grounds relating to the data subject's particular situation (Art. 21);
• withdrawal of consent at any time, without affecting the lawfulness of processing based on consent given before its withdrawal (Art. 7(3)), where applicable.

Requests should be sent to info@hawkings.it or via certified email (PEC) to hawkings@pec.it. The Controller will respond without undue delay and in any event within one month of receipt; this period may be extended by a further two months where necessary, taking into account the complexity and number of requests (Art. 12(3) GDPR). The exercise of these rights is free of charge, except for manifestly unfounded or excessive requests.

The data subject also has the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali), Piazza Venezia 11, 00187 Rome, Italy (www.garanteprivacy.it - protocollo@pec.gpdp.it), or with the supervisory authority of the EU Member State in which they habitually reside, work or in which the alleged infringement occurred.

8. Automated decision-making

The Controller does not make decisions based solely on automated processing, including profiling, which produce legal effects concerning the data subject or similarly significantly affect them (Art. 22 GDPR). Interactions with the Website, including product simulations, do not involve any automated decision-making.

9. Minors

The Website is intended for businesses and professionals. The Controller does not knowingly collect data of minors under 18 years of age.

10. Changes to this policy

The Controller may update this policy, including as a result of regulatory changes or the introduction of new services. The current version is always published on this page, with the date of the last update.
