REA BG-497085, capitale sociale € 100,00, email info@hawkings.it, PEC hawkings@pec.it ("Hawkings").
2. Oggetto e accettazione
I presenti Termini regolano l'accesso al Sito e il suo utilizzo, ai sensi del D.Lgs. 70/2003 (attuazione della Direttiva 2000/31/CE sui servizi della società dell'informazione) e della normativa applicabile. Navigando il Sito, l'utente accetta i Termini nella versione pubblicata al momento dell'accesso. Se non li accetta, è invitato a non utilizzare il Sito.
3. Natura dei contenuti
Il Sito ha finalità esclusivamente informativa e presenta i prodotti e i servizi di Hawkings a imprese e professionisti.
I contenuti, le simulazioni del prodotto, i numeri e i casi d'uso mostrati hanno carattere illustrativo e non costituiscono offerta al pubblico ai sensi dell'art. 1336 c.c. né impegno contrattuale. Caratteristiche tecniche, tempi di realizzazione, prezzi e modalità di acquisto o noleggio sono definiti esclusivamente nell'offerta e nel contratto sottoscritti tra Hawkings e il cliente.
Le simulazioni presenti sul Sito funzionano solo nel browser dell'utente e non trasmettono alcun dato a Hawkings.
4. Prenotazione della demo
La prenotazione della demo è gratuita e non comporta alcun obbligo di acquisto. Avviene tramite la piattaforma di terze parti Cal.com, il cui utilizzo è soggetto anche ai termini di servizio di Cal.com. Il trattamento dei dati è descritto nell'Informativa Privacy.
5. Proprietà intellettuale
Testi, grafica, immagini, illustrazioni, video, codice, loghi e marchi presenti sul Sito, incluso il marchio "Hawkings", sono di proprietà di Hawkings o dei rispettivi titolari e sono protetti dalla normativa sul diritto d'autore e sulla proprietà industriale. I marchi Cuadro, Emoda e Atqua appartengono ai rispettivi titolari.
È consentita la consultazione per uso personale e interno. È vietata ogni riproduzione, modifica, distribuzione o utilizzo commerciale dei contenuti senza autorizzazione scritta di Hawkings.
6. Utilizzi vietati
L'utente si impegna a non:
- utilizzare il Sito per scopi illeciti o contrari ai presenti Termini;
- tentare di accedere senza autorizzazione ai sistemi di Hawkings o comprometterne la sicurezza e il funzionamento;
- estrarre in modo sistematico i contenuti del Sito (es. scraping), anche per addestrare sistemi di intelligenza artificiale, fatto salvo quanto consentito dalla legge;
- decompilare o effettuare reverse engineering del codice del Sito, nei limiti consentiti dalla legge.
7. Link a siti di terzi
Il Sito può contenere link a siti di terzi. Hawkings non controlla tali siti e non è responsabile dei loro contenuti, servizi o politiche privacy.
8. Responsabilità
Hawkings cura l'accuratezza e l'aggiornamento dei contenuti, ma non garantisce che siano sempre completi, aggiornati o privi di errori, né che il Sito sia disponibile senza interruzioni.
Nei limiti consentiti dalla legge, Hawkings non è responsabile dei danni derivanti dall'uso del Sito o dall'impossibilità di utilizzarlo. Resta ferma la responsabilità per dolo o colpa grave (art. 1229 c.c.) e ogni altra responsabilità che non può essere esclusa per legge.
9. Modifiche
Hawkings può modificare in qualsiasi momento i presenti Termini e i contenuti del Sito. La versione in vigore è quella pubblicata su questa pagina.
10. Legge applicabile e foro competente
I presenti Termini sono regolati dalla legge italiana.
Per le controversie con utenti che agiscono per scopi professionali o imprenditoriali è competente in via esclusiva il Foro di Bergamo. Se l'utente è un consumatore, resta fermo il foro inderogabile del luogo di sua residenza o domicilio (art. 66-bis D.Lgs. 206/2005) e sono fatte salve le tutele del Codice del Consumo.

2. Scope and acceptance
These Terms govern access to and use of the Website, pursuant to Italian Legislative Decree 70/2003 (implementing Directive 2000/31/EC on information society services) and applicable law. By browsing the Website, the user accepts these Terms in the version published at the time of access. If the user does not accept them, they are invited not to use the Website.
3. Nature of content
The Website is intended solely for informational purposes and presents the products and services of Hawkings to businesses and professionals.
The content, product simulations, figures and use cases shown are illustrative in nature and do not constitute a public offer within the meaning of Art. 1336 of the Italian Civil Code, nor a contractual commitment. Technical specifications, timelines, prices and purchase or lease terms are defined exclusively in the offer and the contract signed between Hawkings and the client.
The simulations on the Website run solely in the user's browser and do not transmit any data to Hawkings.
4. Demo booking
Booking a demo is free of charge and does not entail any obligation to purchase. It takes place via the third-party platform Cal.com, whose use is also subject to Cal.com's terms of service. The processing of personal data is described in the Privacy Policy.
5. Intellectual property
Text, graphics, images, illustrations, videos, code, logos and trademarks on the Website, including the "Hawkings" trademark, are the property of Hawkings or their respective owners and are protected by copyright and industrial property law. The trademarks Cuadro, Emoda and Atqua belong to their respective owners.
Viewing for personal and internal use is permitted. Any reproduction, modification, distribution or commercial use of the content without the prior written authorisation of Hawkings is prohibited.
6. Prohibited uses
The user agrees not to:
- use the Website for purposes that are unlawful or contrary to these Terms;
- attempt to gain unauthorised access to Hawkings' systems or compromise their security or operation;
- systematically extract content from the Website (e.g. scraping), including for the purpose of training artificial intelligence systems, except where permitted by law;
- decompile or reverse-engineer the Website's code, except where permitted by law.
7. Links to third-party websites
The Website may contain links to third-party websites. Hawkings does not control such websites and is not responsible for their content, services or privacy practices.
8. Liability
Hawkings takes care to ensure the accuracy and currency of the content, but does not guarantee that it is always complete, up to date or error-free, nor that the Website will be available without interruption.
To the fullest extent permitted by law, Hawkings shall not be liable for any damage arising from the use of the Website or the inability to use it. Liability for wilful misconduct or gross negligence (Art. 1229 Italian Civil Code) and any other liability that cannot be excluded by law shall remain unaffected.

10. Governing law and jurisdiction
These Terms are governed by Italian law.
For disputes with users acting for professional or business purposes, the courts of Bergamo, Italy, shall have exclusive jurisdiction. If the user is a consumer, the mandatory jurisdiction of the courts of their place of residence or domicile shall apply (Art. 66-bis of Italian Legislative Decree 206/2005, Consumer Code), and all applicable consumer protection rights are reserved.
